'Criminal' ditulis dan diproduksi oleh Max Martin dan Shellback, dengan tulisan tambahan oleh Tiffany Amber.

Setelah Spears pertama kali mendengarkan lagu itu, dia merasa itu berbeda dan tidak seperti apa pun yang pernah dia dengar sebelumnya.

Dia memposting cuplikannya secara online pada 2 Maret 2011, sebelum rilis album.

'Criminal' dipilih sebagai single oleh polling di halaman Facebook-nya , seperti yang dijelaskan Spears sebagai cara untuk membalas budi kepada para penggemarnya.
